The Mental Health Act 2007 provides a framework for the provision of mental health care and treatment. Key principles of the Act include that care and treatment:

  • be designed to assist people with mental illness or mental disorder, wherever possible, to live, work and participate in the community;
  • be timely and high quality and in accordance with professionally accepted standards; and
  • be provided in the least restrictive environment enabling the care and treatment to be effectively given.

Some provisions to supplement the operation of the Act can be found in the Mental Health Regulation 2007.

An Information Bulletin prepared by the Mental Health and Drug & Alcohol Office provides a summary of some of the key features of the Mental Health Act 2007, which is effective from 16 November 2007.
