Medicines, Poisons and Therapeutic Goods legislation update

The Poisons and Therapeutic Goods Act 1966 (NSW) (the Act) and the Poisons and Therapeutic Goods Regulation 2008 (NSW)(the Regulation) form the primary legislative framework that regulates the supply of medicines, poisons, and therapeutic goods in New South Wales.

This framework is scheduled to be replaced in 2026 by the Medicines, Poisons and Therapeutic Goods Act 2022 (NSW) (MPTG Act), which was passed in NSW Parliament in November 2022, along with the Medicines, Poisons and Therapeutic Goods Regulation, expected to also be finalised in 2026 once approved by the Minister.

Once a commencement date of the new MPTG Act and Regulation is set, Pharmaceutical Services will work closely with stakeholders to raise awareness of the legislative changes relevant to each profession and area of practice. Updates will be posted on this page.

Consultation on cosmetic use medicines

NSW Health invites feedback on proposed regulatory changes aimed at strengthening controls on cosmetic use substances. These measures seek to ensure safer, higher quality cosmetic services for the community.

The proposed changes include:

  • strengthening professional accountability, requiring health practitioners to ensure robust systems and policies are in place for the safe delivery of cosmetic services
  • increasing penalties for the use of unregistered cosmetic use substances.
